Military Tribunals to Resume as Soon as Early 2007

Military tribunals could resume at Guantanamo Bay as soon as early 2007 if Congress approves new legislation to try the detainees.   The Department of Defense would have three months after the passage of the legislation to come up with new rules for the tribunals, which were struck down by the Supreme Court in June 2006.

To make matters clear, a military tribunal is a kind of military court designed to try members of enemy forces during war time.  The judges in these tribunals are military officers and fulfill the roles of jurors.

As sited on my "Guantanamo Prison Ruled to be Illegal" post on June 30, 2006, the U.S. Supreme Court stopped all military tribunals on the basis that they violated the Geneva Convention.  I do not have a problem with overseas prisons or military tribunals as long as they are done within the guidelines stated in the Geneva Convention.  As long as these courts follow the upcoming tribunal rules of action, I will have no problem with this.

This issue is just one issue that the Republican Party is trying to spin on the Democrats.  Republicans are portraying the Democratic party as being "sided with the terrorists" or "weak on terror".  This is not the case at all.  The fact is Democrats are not weak on terror and none of them side with the terrorists.  All the Democratic party is fighting for is for the tribunals to be conducted according to international law (the Geneva Convention) and national law.  All this fuss is just a way for the Republicans to spin an issue to try to gain a political advantage.

Well, there are a few Republicans that also want the tribunals to be conducted according to the Geneva Convention. Sen. Lindsey Graham, Sen. John Warner, and a few others are very concerned that our national image has been damaged by the actions of our Armed Services. They have voiced the need for us to rise above and stay true to our values and not stoop to the level of the terrorists. Graham is a formidable proponent of doing things right and preserving our image in the world. He has actually been involved in military tribunals and is known for his expertise on military code.

As far as the Repubs trying to put the spin on Dems being "weak on terror" I think it's up to us, the American People, to put a stop to this kind of talk. We can demand that our representatives stop the hateful speech towards each other and we can also send a verrrrry strong message in November by voting 3rd party, and force the legitimacy of other Parties. We really do need some new blood on The Hill as our present reps have taken us for granted for too long. We need to call our reps and tell them we plan on reclaiming the We/By/For as in We the People, By the People and For the People. We need to tell them we won't participate in any North American Union, and we don't want a superdupertrooper highway running from Mexico to Canada like a scar up our midsection.

We the People ought to distract the 2 Party's from maligning each other by refusing to accept our lives are totally consumed by their "war on terror" just like Americans let them know we won't stoop to torture and we will expose wrongdoing by our elected officials. I personally have a problem with rendition. It's a cowardly act. We should at least demand from our elected elites the decency of making terrorists screech and writhe in agony here on our own soil. ;)

I think that preserving our American image has to be the key part in all of this. We are really under the microscope in the eyes of the rest of the world, and they aren't looking at us too clearly.

I hope that Congress can come up with a bill that will satisfy both the President and the Supreme Court. At the moment, the President wants to be able to do whatever he thinks he wants to do because we are in times of war. Well under our Constitution, no special power is given in such a case. A new bill needs to be drafted soon so we can give these detainees that just been moved to Gitmo a trial so we can give justice to the American people.

I totally agree with your comments, tfruge1. Nice to know we're in accord with Sens. Graham, McCain & Warner on this one very important issue to do with our *image*. Graham gave a very eloquent speech (colloquy?) on the floor of the Senate before their August recess which was covered by C-SPAN. Those three gentlemen made it quite clear to the listeners that our image in the world had always been exemplary and they're very concerned about the state of affairs playing out at this time. You know, it's almost as though they have taken the reins on this horse quite unperturbed that Bush still sits on his *ss waving palm leaves in our faces. Like they're humoring him while doing damage control off camera. Sometimes I can't believe what a bloody mess this admin has put us in. I think of the honey vs. vinegar thingee. Oh, and what makes the Prez think he can emulate Prez Reagan and bring out the old Evil Axis card and be taken seriously? BTDT. Or get away with it, even? Mercy!
